DON'T WAIT TOO LONG:

The Social Security Administration has a strict time limit of 60 days for filing appeals. It is important to pursue any possible appeal promptly. If you have applied for benefits and your claim was denied, contact Mathis & Mathis today for a free, no-obligation consultation.

Administrative Hearing

Requesting a Hearing for SSDI or SSI Benefits

If you are again denied disability benefits after filing a request for reconsideration, the next step in the appeals process is to request a hearing. For many people who are too disabled to work, the idea of going through a formal legal hearing to get disability benefits is extremely frustrating and discouraging.

At Mathis & Mathis, P.C., a disability benefits law firm representing clients in and around Washington, DC, Northern Virginia, Baltimore and the Mid-Atlantic region, we tell all our clients not to despair. The administrative hearing stage of the process of applying for disability benefits is the most important stage of the entire process.

Success at the Administrative Hearing Level: In 2005, two-thirds of people who were eventually approved for benefits under the Social Security disability insurance (SSDI) or Supplemental Security Income (SSI) program were approved at the administrative hearing stage.

About the Administrative Hearing for Social Security Disability Benefits

You have 60 days from the date your request for reconsideration is denied to request the administrative hearing. This stage of the appeals process is important because it is your opportunity to present all your evidence to an administrative law judge, your chance of winning may be greatly increased by help from an attorney or certified claimant's representative.

The administrative law judge has independent authority to make a ruling on your claim based on the evidence presented by your lawyer or your representative. The judge does not have to rely on earlier rulings, and the judge's ruling does not have to be approved by the Social Security Administration.

Currently, many Social Security hearing offices have significant backlogs, and it can take as long as one year to 18 months to get a hearing date. We can use this time to develop evidence that will support your claims.
